New Jersey Retaining Wall Permit Requirements

Statewide Building Code

New Jersey enforces the 2018 International Residential Code (IRC), New Jersey Edition and the 2018 International Building Code (IBC) through the New Jersey Uniform Construction Code (UCC). These codes serve as the foundation for building regulations across the state, with local municipalities authorized to implement additional requirements.Legal Information Institute+1Legal Information Institute+1

R404.4 Retaining Walls

Section R404.4 Retaining Walls of the IRC specifies:

  • Retaining walls over 4 feet in height or those supporting additional loads (e.g., slopes, structures) must be designed by a licensed professional engineer.
  • Such walls must be constructed in accordance with accepted engineering practices to ensure stability against overturning, sliding, excessive foundation pressure, and water uplift.

These requirements are enforced statewide under the UCC.

When Is a Retaining Wall Permit Required?

In New Jersey, permit requirements for retaining walls generally include:

  • Zoning Permit: Required for walls under 4 feet in height.
  • Construction Permit: Required for walls 4 feet or taller, or those supporting a surcharge.

For example, the Township of Millburn states:

“The retaining wall requires a permit from both the Building Department and the Engineering Department. If the wall exceeds 4 feet in height, engineering calculations are required from a NJ licensed professional engineer.”

Additionally, Mountainside requires:

“Retaining walls, four feet or less in height, require a zoning permit. Retaining walls, in excess of 4 feet in height, require a State of NJ construction permit.”

Front Yard Setback Requirements

Setback requirements for retaining walls vary by municipality. For instance, Howell Township advises:

“Both property lines along the street have a front yard setback. Please contact the Land Use Department or refer to Question Number 8 for what the front yard setback is for your zone.”

It’s essential to consult your local zoning office to determine specific setback requirements for your property.
